Terms of Service

1. Acceptance of Terms

By accessing or using Outpick (outpick.me), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

2. Description of Service

Outpick is a sports pick'em platform where players make spread-based picks on professional and college football and basketball games, compete in private leagues, follow live scoring and standings, chat with league members, and participate in head-to-head Rivalries. Outpick offers free player accounts, paid league creation plans (Outpick League, Outpick League Pro, Outpick Office), and an optional premium individual subscription (Outpick+) with AI-powered analysis and advanced analytics.

3. Accounts & Eligibility

• You must be at least 18 years old to use Outpick.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and current information when creating your account.
• You may not share your account with others or create multiple accounts.

4. League Purchases, Subscriptions & Billing

Playing in an Outpick league is free for players. League creation is a paid one-time purchase per season, and Outpick+ is an optional recurring individual subscription. By purchasing, you authorize Outpick to charge your payment method.

• Outpick League: $24.99 per season (up to 25 players).
• Outpick League Pro: $49.99 per season (up to 100 players).
• Outpick Office: $199 per season (up to 250 players).
• Outpick+: $14.99 per year, billed annually and auto-renewing unless cancelled before the renewal date.
• League purchases are one-time seasonal charges and do not auto-renew. League upgrades are available mid-season at the difference in price.
• You may cancel Outpick+ at any time from your billing settings. You will retain access until the end of your current billing period.
• Refunds are not provided for partial billing periods or partially completed seasons.
• Payments are processed securely by Stripe. Outpick does not store your payment information.

5. Leagues, Picks & League Data

Outpick leagues are organized by commissioners who purchase and manage them. By joining a league, you acknowledge that your display name, profile photo, standings position, and weekly results are visible to that league's members, and that your picks become visible to other league members once each picked game has started. Chat messages you send are visible to all members of that league. Commissioners may manage membership and settings within their leagues. Outpick is not responsible for disputes between league members or commissioners arising from shared league data.

6. No Gambling or Wagering

Outpick is a skill-based prediction game for entertainment. Outpick does not offer, accept, or facilitate wagers, bets, or gambling of any kind, and does not award cash prizes. Any private arrangements between league members are solely between those members, and you are responsible for complying with the laws of your jurisdiction. Point spreads displayed in Outpick are informational game data used for scoring and do not constitute an offer to bet.

7. AI Features Disclaimer & User Accountability

Outpick+ uses artificial intelligence to generate Edge Scores, matchup analysis, pick suggestions (Build My Picks), personal coaching insights, and You vs AI comparisons. By using these features, you acknowledge and agree to the following:

• AI limitations: AI-generated content can and will make mistakes. Edge Scores, analyses, and suggestions may be inaccurate, incomplete, or based on outdated market data. You must independently evaluate all AI output before acting on it.
• Not advice: Outpick AI features are for entertainment and informational purposes within the game. They do not constitute betting, financial, or professional advice of any kind.
• Your accountability: Any picks you make — with or without AI assistance — are your sole responsibility. Outpick is not liable for outcomes resulting from your use of or reliance on AI-generated content.
• No guarantees: Outpick makes no warranties, expressed or implied, regarding the accuracy, reliability, or effectiveness of any AI-generated content. AI performance may vary and is not guaranteed.

By continuing to use Outpick's AI features, you confirm that you understand these limitations and accept full responsibility for how you interpret and act on AI-generated content.

8. Acceptable Use

You agree not to:

• Use Outpick for any unlawful purpose.
• Attempt to reverse-engineer, hack, or interfere with the service.
• Post harmful, offensive, or inappropriate content in league chat or profiles.
• Use the service to harass, stalk, or harm another person.
• Attempt to access another user's account without authorization.
• Use bots, scrapers, or automated tools to make picks or extract data.

9. Intellectual Property

All content, design, and code of Outpick is the property of Outpick and is protected by applicable intellectual property laws. You retain ownership of the personal data you enter into the app. Outpick is an independent product and is not affiliated with, endorsed by, or sponsored by the NFL, NBA, NCAA, or any team or school; league and team names are used solely to identify games for scoring purposes.

10. Third-Party Data

Schedules, scores, and point spreads are provided by third-party sports data providers. While we work to keep this data accurate and timely, Outpick does not guarantee its completeness or accuracy and is not responsible for scoring outcomes resulting from delayed or corrected provider data.

11. Limitation of Liability

Outpick is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Outpick shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability to you shall not exceed the amount you paid for the service in the 12 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service. You may delete your account at any time by contacting us.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of Outpick after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in the courts of the jurisdiction in which Outpick operates.
